Remedies for the passenger in case of a canceled flight

We are facing the cancellation of a flight when the airline does not operate the scheduled transport, despite the regular booking of the passenger.

In this case the carrier has the following obligations:

  • Offer the passenger the choice between the restart (alternative flight) to the final destination and the refund of the full ticket price within seven days;
  • Offer the passenger meals and drinks and, if necessary, hotel accommodation until the new departure, in addition to transportation between the airport and the place of accommodation;
  • Pay the passenger a cash compensation which, depending on the length of the route, varies from 250 € to 600 €.

Conditions under which the passenger is not entitled to cash compensation

There are basically 3 cases in which the airline is not required to pay the European compensation to the passenger:

  • the flight was canceled due to exceptional events, such as a strike or bad weather;
  • the passenger was informed of the cancellation of the flight at least two weeks in advance;
  • the flight departs from an airport located in a non-EU country, operated by a non-European carrier (in this case the passenger is still entitled to a compensation).
